These Terms & Conditions govern the access to and use of the website ecaticos.com (hereinafter, the "Site"), operated by Ecaticos Plataforma Inmobiliaria S.A. (hereinafter, "Ecaticos"), an Ecuadorian company with Tax ID 1793256874001 and registered office in Quito, Ecuador. By using the Site you accept these terms in full.
1. Purpose
The Site's purpose is to provide information about the real estate crowdlending services offered by Ecaticos in Ecuador and to allow subscription to its newsletter. The Site does not constitute a direct investment offer; any investment will be formalised on the transactional platform, subject to specific contracts.
2. User status
To use the Site you must be of legal age under Ecuadorian law (18 years) and accept these terms. By subscribing to the newsletter you warrant that the data provided is true and up to date.
3. Intellectual property
All texts, graphics, logos, images and other content of the Site are the property of Ecaticos or used under licence and are protected by Ecuador's intellectual property legislation (Organic Code of the Social Economy of Knowledge, Creativity and Innovation).
4. Permitted use
You may freely consult the information published on the Site for personal, non-commercial purposes. Copying, reproducing, distributing or creating derivative works without prior written authorisation from Ecaticos is prohibited.
5. Newsletter
Subscription to the newsletter is free and voluntary. You will receive emails about new projects, analysis of the Ecuadorian real estate market and corporate information. You can unsubscribe at any time using the link included in each email.
6. Limitation of liability
The information published is for informational purposes only and does not constitute financial, tax or legal advice. Past performance does not guarantee future results. Ecaticos is not responsible for technical interruptions of the Site, third-party cyber-attacks, force majeure or unforeseeable events.
7. Risks of real estate crowdlending
Investing via crowdlending entails the risk of total or partial loss of capital. Before investing in any project you must read the specific documentation, including the legal review, the appraisal and the risk analysis. Ecaticos does not guarantee the recovery of capital nor the promised return.
8. Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Ecuador. Any dispute shall be submitted to the courts and tribunals of the city of Quito, except where mandatory consumer protection law sets a different jurisdiction.
9. Amendments
Ecaticos may amend these Terms & Conditions at any time. Changes will be effective from their publication on the Site.
